These Terms and Conditions ("Terms") govern your access to and use of the Delzy mobile application, the website at https://delzy.in (and related pages), and related services (collectively, the "Service") operated by Inficrux AI Solutions LLP ("Inficrux", "we", "us", or "our").

By downloading, registering for, or using the Service, you agree to these Terms and our Privacy Policy at https://delzy.in/privacy-policy. If you do not agree, do not use the Service.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and place orders, or use the Service only with consent and supervision of a parent or legal guardian where permitted by law.

You must provide accurate registration information and have the legal capacity to enter into a binding agreement. The Service is intended for users in areas where Delzy operates.

Delzy is a technology platform that connects customers with independent partner shops and delivery riders. Inficrux provides the platform; partner shops are responsible for preparing orders, and riders are responsible for pickup and delivery, except where Delzy or its affiliates perform delivery directly.

We may add, modify, or discontinue features (including categories, shops, zones, or payment methods) at any time with reasonable notice where practicable.

To use certain features you must register with a valid mobile number and complete OTP verification (or other authentication we provide). You are responsible for maintaining the confidentiality of your account and for all activity under your account.

Notify us promptly at support@delzy.in if you suspect unauthorized access. We may suspend or refuse registration if we detect fraud, abuse, or violation of these Terms.

When you place an order through Delzy:

Estimated delivery times are indicative only and not guaranteed. Delays may occur due to traffic, weather, shop preparation time, rider availability, or events beyond our reasonable control.

You agree to be available at the delivery location and to receive the order in a safe and lawful manner. If you cannot be reached, the order may be cancelled or handled per our operational policies, and applicable charges may still apply.

Where Delzy offers pickup-and-drop or parcel services, pricing may be based on distance, weight, or service type as shown at checkout. You represent that items comply with applicable law and are accurately described. We may refuse prohibited, hazardous, illegal, or unsafe items.

You agree not to:

Products sold by partner shops are offered by those shops, not by Inficrux. Product quality, labelling, allergens, and compliance with food or product regulations are primarily the shop's responsibility, though we may assist with support requests.

Riders act as independent delivery partners or contractors unless otherwise stated. Inficrux is not the employer of partner shops or riders for purposes of their relationship with you, except where explicitly required by law.

The Delzy name, logo, app, website, and related content are owned by Inficrux AI Solutions LLP or its licensors. You receive a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, or use our branding without written permission.

Your use of the Service is also governed by our Privacy Policy at https://delzy.in/privacy-policy, which explains how we collect and use personal information. By using Delzy you consent to those practices.

The Service is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted, error-free, or secure operation.

To the maximum extent permitted by applicable law, Inficrux AI Solutions LLP and its directors, officers, employees, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill arising from your use of the Service.

Our total liability for any claim relating to the Service shall not exceed the greater of (a) the amount you paid to us for the relevant order in the twelve (12) months before the claim, or (b) INR 5,000, except where a higher limit is required by applicable consumer protection law.

You agree to indemnify and hold harmless Inficrux AI Solutions LLP from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, violation of these Terms, or violation of any law or third-party rights.

We may suspend or terminate your access immediately for breach of these Terms, fraud, legal requirements, or operational reasons. You may stop using the Service at any time and may request account deletion as described in our Privacy Policy.

Sections that by nature should survive (including disclaimers, limitation of liability, indemnity, and governing law) will survive termination.

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts in India shall have exclusive jurisdiction, subject to any mandatory consumer protection rights in your jurisdiction.

Before formal proceedings, you agree to contact support@delzy.in so we can try to resolve disputes in good faith.

We may update these Terms by posting a revised version at https://delzy.in/terms with an updated "Last updated" date. Material changes may be communicated via the app, email, or other reasonable means. Continued use after changes take effect constitutes acceptance.
